High Court stays status quo order on Deccan Chargers' termination

Mumbai: The Bombay High Court has given a stay order against the status quo issued by the arbitrator appointed in the Deccan Charger's termination case.

The appeal against the arbitrator was heard to today in the morning and after hearing both the parties, High Court ruled the case in BCCI’s favour which means that the termination of the Deccan Chargers from the IPL stands.

The court had earlier appointed retired Supreme Court judge judge C K Thakker as the sole arbitrator to verify whether the September 14 termination notice issued by BCCI to Deccan Charges is valid or not.

He was given three months time to submit his report but after Deccan Chargers failed to furnish the 100 crore bank guarantee meant that now the BCCI stood full authority to take any action it desires as far as the Deccan Chargers are concerned.

But the arbitrator put a status quo on the termination until his next hearing. The BCCI appealed to the court because they felt once the Deccan Chronicle Holdings Ltd. failed to submit the money, the termination effect would not have any effect to it due to status quo granted by the arbitrator.

The BCCI moved to the court feeling that the arbitrator has exceeded his jurisdiction.

Earlier DHCL was denied any further extension by the Bombay High Court for furnishing Rs 100 crore to BCCI for their Indian Premier League Franchisee Deccan Chargers.

The deadline for submitting the bank guarantee came to an end on Friday at 5 pm and the High Court has refused to grant any further time to DHCL saying that they already extended the earlier date by three days.

The DHCL was ordered by the high court on October 1 to give the bank guarantee of 100 crore after they filed a petition against the BCCI’s decision to terminate their IPL team Deccan Chargers.
